Today is a IMCO day. They are 2 very important amendmends to support:
(fb) applying the principle that no restriction may be imposed on the fundamental rights and freedoms of end- users, without a prior ruling by the judicial authorities, notably in accordance with Article 11 of the Charter of
Fundamental Rights of the European Union on freedom of expression and information, save when public security is threatened in which case the ruling may be subsequent.
Access to content, services and applications
Member States shall ensure that any restrictions on the rights of users to access content, services and applications, if such restrictions are necessary, are implemented by appropriate measures, in accordance with the principles of proportionality, effectiveness and dissuasiveness.
Those measures shall not have the effect of hindering the development of the information society, in compliance with Directive 2000/31/EC of the European Parliament and of the Council of 8 June 2000 on certain legal
aspects of information society services, in particular electronic commerce, in the Internal Market (Directive on electronic commerce)*, and shall not conflict with the fundamental rights of citizens, including the right to privacy and the right to due process.
